Legionella Risk Assessments, Testing and Certification to HSE approved guidance standards. What the Law says: General duties are outlined in Section 3(2) of the Health & Safety at Work Act; this imposes a duty of care owed by landlords to tenants. The Control of Substances Hazardous to Health Regulations known as COSHH are also relevant.
Commercial Landlords and Property Owners have a duty to assess exposure as regards potential exposure to Legionella and implement suitable controls. This applies to any premises used in connection with a trade or business or otherwise where water is stored.
Landlords of domestic rental properties also have a legal duty to assess exposure from Legionella in order to ensure the safety of their tenants. This includes: Local Authorities, Housing Associations, Private Sector Landlords, Housing Co-operatives and Hostels.
The duty requires a structured property-specific risk assessment and may in some cases require what is commonly known as a “Legionnaires Test Certificate”. B-Safe can help in providing the initial risk assessment to undertaking controlled testing where required, all at competitive costs.
